These Terms of Use (“Terms”) govern your access to and use of the website operated by Polite Society Industries, LLC (“Polite Society,” “we,” “us,” or “our”), including all content, features, and services available through the site (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.


1. Eligibility and Acceptance

You must be at least 21 years of age to access or use the Site. By using the Site, you represent and warrant that you are at least 21 years of age, that you have the legal capacity to enter into these Terms, and that you will comply with all applicable laws.

The Site is intended for users located in the United States. We make no representation that the Site or its content is appropriate or available for use in any other location.

2. Permitted Use

The Site is provided for informational and promotional purposes related to Polite Society products and the firearms industry. You may view and use content on the Site for your personal, non-commercial use only.

You may not:

  • Copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our prior written permission;
  • Use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site;
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;
  • Use any automated means, including bots, scrapers, or similar tools, to access or collect data from the Site without our express written consent;
  • Use the Site for any unlawful purpose or in violation of any applicable local, state, or federal law.

3. Intellectual Property

All content on the Site — including text, graphics, logos, product images, designs, trademarks, trade dress, and the “Polite Society” name and branding — is owned by or licensed to Polite Society and is protected by United States and international intellectual property laws.

Our marks include, without limitation: Polite Society Industries; Tripass Core Technology™; Acoustic Golfball Dimpling™; HUB Mounted Brake™; “Silence is a courtesy.”; and the PS monogram and soundwave device.

Nothing on the Site grants you any right, title, or interest in our intellectual property. Any unauthorized use may violate copyright, trademark, and other laws.

4. Product Information and Dealer Sales

All product information, specifications, images, and descriptions on the Site are provided for general informational purposes only. Actual products may vary. Availability, pricing, and specifications are subject to change without notice.

Polite Society products are sold exclusively through authorized dealers and distributors. We do not sell products directly to consumers through this Site. Any purchase of Polite Society products must be made through an authorized dealer in accordance with all applicable federal, state, and local laws, including National Firearms Act (NFA) requirements.

We make no representations or warranties regarding the legality of ownership or possession of any product in any particular jurisdiction. It is solely the responsibility of the purchaser and the dealer to ensure full compliance with all applicable laws.

5. Accuracy of Technical Information

Technical descriptions on the Site — including specifications, weights, dimensions, materials, caliber compatibility, and descriptions of internal design and performance — are provided for general informational purposes. Product performance varies with host firearm, barrel length, ammunition, environmental conditions, and maintenance. Nothing on the Site constitutes a guarantee of any particular level of sound reduction or performance.

6. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES WITH RESPECT TO THE SITE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Site at your own risk.

Product warranty. The disclaimers in this Section apply to the Site and its content only. They do not limit, modify, or disclaim any express written warranty provided with a Polite Society product. That warranty is stated in full in The Guarantee, available on the Site, which is the complete statement of our warranty obligations with respect to products.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLITE SOCIETY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Polite Society, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

9. Third-Party Links and Content

The Site may contain links to third-party websites or resources. These links are provided for convenience only. We do not control, endorse, or assume responsibility for any third-party sites, content, or practices. Your use of third-party sites is at your own risk and subject to the terms and policies of those sites.

10. Submissions and Feedback

The Site may allow you to submit information through contact forms, dealer applications, or similar features (“Submissions”). You are solely responsible for your Submissions and represent that you have all rights necessary to provide them.

Please do not send us confidential or proprietary information. Any ideas, suggestions, feedback, or product concepts you send us are provided on a non-confidential basis, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without compensation or attribution.

We may remove, modify, or decline to act on any Submission at any time and for any reason.

11. Export Compliance

Products and technical data described on the Site are subject to United States export control laws and regulations. You may not export, re-export, or transfer any product or technical data obtained from or described on the Site except in full compliance with all applicable United States laws and regulations.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect information.

13. Changes to the Site and These Terms

We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. The Effective Date at the top of this page will indicate when the Terms were last revised. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

15.1 Informal resolution. Before filing a claim, you agree to contact us at hello@politesocietyind.com and attempt to resolve the dispute informally. We will attempt in good faith to resolve any dispute within sixty (60) days of receiving notice.

15.2 Agreement to arbitrate. If a dispute is not resolved informally, you and Polite Society agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.

15.3 Location. Arbitration shall take place in Hillsborough County, Florida, or, at your election, by telephone, videoconference, or on the basis of written submissions.

15.4 Class action waiver. YOU AND POLITE SOCIETY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

15.5 Jury trial waiver. YOU AND POLITE SOCIETY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY DISPUTE SUBJECT TO ARBITRATION UNDER THIS SECTION.

15.6 Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

15.7 Right to opt out. You may opt out of this arbitration agreement by sending written notice to hello@politesocietyind.com within thirty (30) days of first accepting these Terms. Your notice must include your name and a statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.

15.8 Severability of this Section. If the class action waiver in Section 15.4 is found unenforceable as to a particular claim, that claim shall be severed from arbitration and brought in the state or federal courts located in Hillsborough County, Florida. The remainder of this Section shall remain in effect.

16. General Provisions

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Entire agreement. These Terms constitute the entire agreement between you and Polite Society regarding your use of the Site and supersede any prior agreements.

Assignment. You may not assign or transfer these Terms or any rights under them. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Electronic communications. By using the Site, you consent to receive communications from us electronically. You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

Force majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control.
